GSA Auctions: fees, payment and what a missed removal costs
GSA's own purchase page names no buyer's premium for GSA Auctions: you pay the award by the sale's deadline (cards up to $24,999.99, one card per transaction), then remove the property yourself; the online terms quoted in federal contract appeals decisions gave 2 business days to pay and 10 to remove, and a June 2024 award notice still said 2 to pay. The cost that bites is the fee for not paying and removing in time: the award itself under $325, a flat $325 from $325 to $100,000, and 5% above that.
So walking away from a $50 win costs $50, from $200 costs $200, and from $1,000 costs $325, and an unpaid fee can be taken from your federal tax refund. GSA Fleet's own vehicle terms are stricter: 10 calendar days to remove, no extensions, and an $875 fee once the award reaches $875. Sales tax isn't addressed in GSA's purchase pages, Standard Form 114C or the federal sale regulation; for GSA Fleet vehicles, the auction house or the registration office collects it.

Where this comes from: The GSA Auctions site itself loads only with JavaScript (checked again Oct 23, 2026), so its current online sale terms couldn't be read. This uses GSA's own pages on gsa.gov, Standard Form 114C (the general sale terms GSA's purchase page says it sells under), the federal sale regulation (41 CFR Part 102-38), and GSA Auctions terms and notices as quoted in 2013, 2021 and 2025 decisions of the Civilian Board of Contract Appeals. For vehicles GSA Fleet sells on GSA Auctions, GSA Fleet's own vehicle sale terms (a PDF on its site) add the stricter rules marked below; check the sale's own terms, since GSA says it can change them.

What you pay on top of the award
- GSA's purchase page lists payment methods and a fee for buyers who don't pay or remove in time. It names no buyer's premium. (GSA, how to purchase, Payment methods)
- GSA sells under Standard Form 114C (April 2001) plus the special terms in each sale's invitation for bid, so read both before bidding. (GSA, how to purchase, Terms and conditions of sale) “Be sure you understand any special terms.”
- Since Dec 16, 2025 the federal sale regulation leaves the terms to each sale, but lists what they must cover, from bid deposits and payments to removal and default. The terms in the offer become your contract. (41 CFR Part 102-38, 102-38.30 and 102-38.75) “Terms and conditions in the offer to sell are normally incorporated into the sales contract and are binding once a bid is accepted.”
- That Dec 16, 2025 final rule rewrote Part 102-38 in a wider update of the Federal Management Regulation, moving its definitions and removing its procedural instructions. GSA's purchase page still says it sells under SF 114C. (Federal Register, Dec 16, 2025, Summary of changes, Part 102-38)
- No financing. (GSA, how to purchase, Payment methods) “The government does not provide any form of financing.”
How and when to pay
- Accepted: wire transfers (Fedwire, ACH); U.S. federal, state or local government checks; MasterCard, Visa, Discover and American Express, processed manually or online through the Treasury's payment service. (GSA, how to purchase, Payment methods)
- Card purchases top out at $24,999.99, one card per transaction. (GSA, how to purchase, Payment methods) “Credit card purchases are restricted to a maximum of $24,999.99, and one card per transaction.”
- Not accepted: other checks, bank drafts, and debit cards with dollar limits or PIN requirements. For a wire, contact the regional sales office for the item first. (GSA, how to purchase, Payment methods)
- Full payment is due within the time the sale's invitation sets, before anything is delivered. (SF 114C, Condition 6) “must be made within the time specified in the Invitation and prior to delivery of any of the property”
- How long that is: the GSA Auctions online terms quoted in Civilian Board of Contract Appeals decisions (for sales in 2012 and October 2019) gave 2 business days from the award email to pay and 10 business days to remove, unless the contract said otherwise; missing either is a default. Check the current terms on the sale before you bid. (CBCA 6958 (2021), Background, The Solicitation Provisions; CBCA 3052 (2013), Findings of Fact) “Property must be removed within ten (10) business days from the date and time of award e-mail notification.”
- The deadline to pay was the same on a June 2024 vehicle sale: the award email, quoted in a November 2025 Board decision, gave the winner 2 business days. (CBCA 8364-DBT (2025), Background) “must pay for this property within 2 business days from the date and time you received this notification”
- GSA Fleet vehicles: GSA Fleet's vehicle sale terms set the same 2 business days from the award email, allow no more than two credit cards per vehicle, and reject a card charge over $24,999.99; a larger payment can't be split into several card charges, on one day or several, to get under that limit. (GSA Fleet vehicle sale terms, Conditions 4 and 6) “a payment timeframe of 2 business days from the time and date of the award e-mail notification of sales results”
Removal
- Pay first, then remove it yourself within the sale's removal period. (GSA, how to purchase, Payment methods) “Purchasers must remove their purchases within the time prescribed for each sale, but they cannot remove merchandise before paying.”
- You arrange packing, removal and transport. The government won't recommend a carrier or act as go-between, and unless the sale says otherwise it doesn't load on Saturdays, Sundays or federal holidays. (SF 114C, Condition 8a)
- If the contracting officer finds a late removal came from causes beyond your control and not your fault (the form lists fires, floods, epidemics, strikes and severe weather among them), that finding is put in writing and a reasonable extension is allowed. If you are allowed to remove late, the government may charge a reasonable storage charge. (SF 114C, Condition 8b)
- Property is released only to you or a representative you authorize in writing, and title passes to you when you remove it unless the sale says otherwise. (SF 114C, Conditions 7 and 8c)
- GSA Fleet vehicles: removal within 10 calendar days (not business days) of the award email, and the government doesn't provide or arrange transport. Bring a driver's license or other government photo ID and the card you paid with online, or a notarized letter from the cardholder. (GSA Fleet vehicle sale terms, Condition 8) “Property must be removed within ten (10) calendar days from the date and time of award e-mail notification.”
If you don't pay or remove in time
- GSA's purchase page: under $325 the fee equals the award; from $325 to $100,000 it is $325; over $100,000 it is 5% of the award. (GSA, how to purchase, Payment methods) “If the award amount is between $325 and $100,000, the fee assessed will be $325.”
- SF 114C's default clause: the government may send a 15-day written notice of default, and if you don't cure it you lose the property and liquidated damages are kept or collected. The 2001 form’s formula is the greater of 20% of the price or $25; the fee above is what GSA’s page gives today. (SF 114C, Conditions 6, 8 and 9)
- GSA Fleet vehicles carry a higher tier: liquidated damages equal the award under $875 and are $875 from $875 up, charged on each lot in default. Those terms also say GSA grants no extensions, and you can't bid again until every default is cured. Not every vehicle on GSA Auctions is sold under them: the 2018 Polaris Ranger XP in the 2025 case below ($6,100) was assessed the general $325, so check which terms the listing carries. (GSA Fleet vehicle sale terms, Condition 9) “GSA does not grant extensions of time for payment and removal.”
- On a lot sold "per lot", taking part of it and leaving the rest gets you no refund. (SF 114C, Condition 9) “no portion of the purchase price will be refunded”
- Unpaid amounts bear interest unless paid within 30 calendar days of the first written demand. (SF 114C, Condition 11)
- The fee is enforced. In that 2021 case a buyer won two vessels for $271,600, first asked for a crane quote about three months after the award (it came to almost $100,000), and never removed them. GSA refunded his payment less $13,580 (5%), and the Board denied his appeal, rejecting his argument that COVID-19 made removal impossible. (CBCA 6958 (2021), Contract Performance; Termination and Appeal) “GSA refunded Mr. Etzin’s money, except that it withheld $13,580 — representing 5% of the original purchase amounts”
- The $325 tier is enforced too. In a 2013 decision a buyer who won an industrial dust collector for $3,855 in July 2012 paid $2,400, then missed even the extended deadline for the rest; GSA refunded $2,075 and kept $325, and the Board upheld it. (CBCA 3052 (2013), Findings of Fact; Decision)
- SF 114C's Privacy Act notice says what GSA may do with your details to collect a delinquent amount on a sale, including reporting it to credit bureaus and offsetting it against your income tax refund. (SF 114C, Privacy Act Notice, routine uses 9 and 10) “offset a Federal claim against a taxpayer's income tax refund”
- An unpaid default fee is collected like any federal debt. In the 2024 vehicle sale, the termination notice set $325 in liquidated damages, due in 30 days with late charges after that; GSA’s demand letters added interest and warned of referral to the Treasury, which then took $382.46 from the buyer’s tax refund. (CBCA 8364-DBT (2025), Background) “Liquidated damages in the amount of $325 must be remitted by you within 30 days of the date of this notice.”
- That buyer got the money back. He said GSA Auctions' payment system kept failing and timed out before the deadline; GSA, which had to prove the debt, didn't answer his evidence and dropped its claim, so the Board found he didn't owe it and ordered GSA to repay the $382.46. If a payment won't go through, keep a record and contact GSA before the deadline. (CBCA 8364-DBT (2025), Discussion; Decision)
Sales tax
- For general surplus, none of the three GSA pages we read (how to purchase, methods of sales, for citizens), SF 114C or 41 CFR Part 102-38 says whether sales tax is charged. (GSA, how to purchase, E-Tools for Citizens: Sales Contracting Officers)
- For GSA Fleet vehicles, the vehicle terms do: you may owe state or local use tax, the government doesn't collect it, and any sales tax is collected by the contracted auction house or by the motor vehicle department when you register the vehicle. The title certificate you get (SF 97-1) doesn't waive registration fees or taxes. (GSA Fleet vehicle sale terms, Conditions 7 and 24) “The U.S. Government is not responsible for collection of state and/or local use taxes.”
- Ask the sales contracting officer named on the sale before you bid if tax matters to your numbers, and ask a tax professional how your state treats it. (GSA, how to purchase, E-Tools for Citizens: Sales Contracting Officers)
Other rules that catch lot buyers
- Quantity can vary: on sales by unit the government may deliver 10% more or less, and by weight 25%, with the price adjusted. On a "price for the lot" sale there is no adjustment. (SF 114C, Condition 12)
- Losses on a lot: no adjustment unless you tell the government before removing any part of that lot. (SF 114C, Condition 14)
- No guarantee of condition; GSA encourages you to inspect before the sale. (GSA, for citizens, No guarantees) “GSA does not guarantee the condition of sale items.”
- The regulation tells selling agencies to give bidders time to inspect, normally at least 7 calendar days. (41 CFR Part 102-38, 102-38.65)
- GSA employees, their spouses and minor children, and their agents can't bid. Sealed-bid sales take bids by mail only, and late bids are never accepted. (GSA, methods of sales, People who may not bid; Sealed bid sale)
- If the price depends on weight, you arrange and pay for the weighing (unless government scales are on site), and any rail switching and spotting charges. (SF 114C, Condition 13)
- A verbal OK to remove late doesn't count. In the 2021 case the buyer said the Navy property custodian agreed he could take longer; the Board held that couldn't bind GSA, because the terms make oral changes unauthorized and only the contracting officer can agree in writing. (CBCA 6958 (2021), Whether Mr. Etzin Was In Default) “Any oral statement or representation by any representative of the Government, changing or supplementing the offering or contract or any condition thereof, is unauthorized and shall confer no right upon the bidder or purchaser.”
- GSA Fleet vehicles are warranted only to match their description, not their condition. A misdescription claim must reach the contracting officer in writing within 15 calendar days of the removal date, while you still own the vehicle in the condition you removed it, and recovery is capped at the price. (GSA Fleet vehicle sale terms, Condition 2)
What to do
- Read the sale’s invitation for bid or online terms for its payment and removal deadlines and any special terms; they become your contract once your bid is accepted.
- Price the removal before you bid: you pack, load and haul, there is no weekend or holiday loading unless the sale says so, and GSA will not recommend a carrier. In a 2021 case the crane quote to move two vessels came to almost $100,000.
- Pay within the deadline (2 business days in the terms quoted in the appeals decisions). If the payment page fails, keep screenshots and contact GSA before the deadline.
- Over $24,999.99, arrange a wire with the regional sales office ahead of time.
- On a per-lot sale, take the whole lot, and report anything missing before you remove any of it.
- Buying a GSA Fleet vehicle? Plan to remove it within 10 calendar days, bring photo ID and the card you paid with (or a notarized letter from the cardholder), and expect no extensions.
- Get any extra time in writing from the contracting officer: a verbal OK from the site custodian didn’t count in the 2021 case.

Questions
Does GSA Auctions charge a buyer's premium?
GSA's how-to-purchase page (last updated Jun 2, 2026) lists payment methods and a default fee but names no buyer's premium. Check the sale's own terms before bidding.
What happens if I don't pick up a GSA Auctions item?
GSA's page says the fee equals the award if it is under $325, is $325 from $325 to $100,000, and is 5% over $100,000; GSA Fleet's vehicle terms set $875 for an award of $875 or more, on each lot. Under Standard Form 114C the government may send a 15-day written notice of default, and if you don't cure it you lose the property. An unpaid fee is a federal debt: in a 2025 case Treasury took it from the buyer's tax refund.
Can I pay GSA Auctions with a debit card?
Not one with dollar limits or a PIN requirement. MasterCard, Visa, Discover and American Express work up to $24,999.99, one card per transaction; wires and government checks are the other options.
How long do I have to remove items from a GSA sale?
The time set in each sale's terms: 10 business days from the award email in the GSA Auctions terms quoted in 2013 and 2021 appeals decisions, and 10 calendar days for GSA Fleet vehicles, whose terms say GSA grants no extensions. Under Standard Form 114C, if the contracting officer finds the delay was beyond your control, a reasonable extension is allowed in writing, and late removal can carry a storage charge.
Can GSA deliver less than the lot listed?
On sales by unit, Standard Form 114C lets the government vary the quantity by 10% (25% by weight) and adjust the price. A "price for the lot" sale has no adjustment.
Do you pay sales tax on a GSA Auctions vehicle?
For GSA Fleet vehicles, GSA's vehicle sale terms say the government doesn't collect state or local use tax; where sales tax applies, the contracted auction house collects it or the motor vehicle department does when you register. The SF 97-1 title certificate doesn't waive registration fees or taxes. For other surplus, GSA's purchase pages don't say, so ask the sales contracting officer.
Can I get the GSA default fee back?
Not in the 2021 case we read: the buyer asked for it back, the contracting officer refused, and the Civilian Board of Contract Appeals upheld the 5% fee ($13,580 on $271,600) for vessels that were never removed. In a 2025 case the Board did order GSA to repay $382.46 taken from a buyer's tax refund for a $325 fee: he said the payment system had failed, and GSA didn't answer his evidence or prove the debt.
General information from each site's and agency's own published pages, checked Oct 23, 2026; not legal or tax advice. Each auction's own terms control, so read them before you bid, and check with a lawyer or tax professional where it matters.
