Taxes / Seller's permits by state / West Virginia
Do I need a seller's permit to sell on eBay or Poshmark in West Virginia?
It depends: the Tax Division's pages don't address marketplace-only sellers directly, but every person engaging in business activity in West Virginia needs a Business Registration Certificate unless it only makes occasional or casual sales, or it collects and withholds no tax, claims no sales tax exemption and had $4,000 or less of business gross income last year. Selling direct from West Virginia (your own site, a store, regular flea market or yard sales) means registering on Form WV/BUS-APP or online at Business4WV.gov and collecting sales tax; the certificate costs $30 and is permanent for that location.
West Virginia calls it a Business Registration Certificate, issued by the West Virginia Tax Division.

If you sell only on eBay, Poshmark and other marketplaces
The pages checked don't single out sellers whose only sales go through marketplaces. The general rule is that anyone engaging in business activity registers, except a person making only occasional or casual sales, or one that is not required by law to collect or withhold any tax, claims no exemption from sales or use tax, and had gross income from business activity of $4,000 or less in all states in the most recent income tax year; out-of-state remote sellers, TSD 317 says, are all required to register even when a small seller exception from collecting applies.
The rule: W. Va. Code § 11-12-3; TSD 360; TSD 317.
"Type 2 marketplace facilitators are required to collect West Virginia sales and use taxes on sales to West Virginia consumers facilitated on and after July 1, 2019."
West Virginia imposes the Consumers Sales and Service Tax and use tax, and municipalities may add up to 1%. Since July 1, 2019, marketplace facilitators that are the merchant of record collect West Virginia sales and use tax on sales they facilitate for third parties.

If you also sell direct: your own site, Facebook, flea markets, consignment
Any person engaging in any business activity in West Virginia must register with the Tax Division before starting, with a separate certificate for each fixed business location, posted where business is conducted. People who regularly and routinely sell goods at yard sales, flea markets or along the roadside are engaged in the business of selling and must register and collect sales tax; out-of-state transient vendors also need a transient vendor license and a $500 bond.
- Fee:
- $30 for a Business Registration Certificate (W. Va. Code § 11-12-3); some organizations, such as qualifying nonprofits and farmers, don't pay the fee.
- Renewal:
- The certificate is permanent until the business's legal name, location or ownership changes, it closes, or the Tax Commissioner suspends or revokes it.
"The fee for obtaining a Business Registration Certificate is $30.00."

Resale certificate: buying inventory without paying sales tax
- Do you need your own permit to give one?
- Not stated on the pages we checked
West Virginia exemptions that need a certificate, including resale, are claimed by giving the vendor a properly executed Certificate of Exemption (Form F0003), the multi-state Streamlined form, and the seller keeps it. If the vendor doesn't get a properly completed certificate, it must collect the tax.
Thrift stores, estate sales and yard sales
TSD 300 says sales of tangible personal property may be made at yard sales without collecting sales tax if the sales are held no more than four times a year and last no longer than 48 hours each.
Misusing a certificate
Form F0003 states that the purchaser is liable for any tax and interest, and possible civil and criminal penalties imposed by the state, if the purchaser is not eligible to claim the exemption.
"The purchaser is liable for any tax and interest, and possible civil and criminal penalties imposed by the state, if the purchaser is not eligible to claim this exemption."

Garage sales, yard sales and other occasional sales
Exempt: yard sales held no more than four times a year, each lasting no longer than 48 hours. Isolated transactions, such as an individual selling personal belongings, are exempt, and yard sales can be held without collecting sales tax within the four-times, 48-hour limits. People who regularly and routinely sell goods at yard sales, flea markets or along the roadside are in the business of selling and must register and collect.
The rule: TSD 300, Isolated Transactions (Rev. January 2026).

Worked examples
The $4,000 small-business test
A West Virginia resident has $3,500 of business gross income in a year, all from marketplace sales. If it is not required by law to collect or withhold any tax and claims no sales or use tax exemption, TSD 360's three conditions mean no Business Registration Certificate is required; at $4,500, or once it claims a resale exemption from suppliers, it would need one.
Counting yard sales
Four weekend yard sales a year, each over by Sunday evening (under 48 hours), stay within TSD 300's limits. A fifth sale, or one that runs three days, falls outside them.
An out-of-state flea market vendor
A seller from another state who brings goods to West Virginia flea markets is a transient vendor: it needs a Business Registration Certificate ($30), a transient vendor license, and a $500 bond posted with the Tax Commissioner before selling.
Edge cases and details
- Claiming a sales or use tax exemption, such as buying inventory for resale tax-free, is one of the things that takes a business out of the $4,000 exception, so a reseller using resale certificates needs to register.
- W. Va. Code § 11-12-3(d)(1) exempts from the $30 fee, though not from registering, a person that must register because it collects tax or claims a sales tax exemption if its gross income was $10,000 or less in the preceding tax year; the Tax Division's FAQ list of fee exemptions doesn't mention this, so confirm it with the Division.
- TSD 360 says operating without a required Business Registration Certificate can bring fines of $1,000 to $10,000 under W. Va. Code § 11-9-12 and a $100-a-day penalty after 30 days under § 11-9-11.
- A business that sells from vehicles must carry a copy of its certificate in each vehicle and display it while selling.
- Corporations, LLCs and limited partnerships register with the Secretary of State first.
What to do
- Marketplace-only: compare your business gross income for the last tax year, and whether you collect tax or claim exemptions, with TSD 360's three conditions; ask the Tax Division or a tax professional if you don't meet all three.
- Selling direct or regularly at yard sales and flea markets: register on Form WV/BUS-APP or at Business4WV.gov ($30) before you start, and post the certificate.
- Buying inventory: give suppliers a completed Form F0003 claiming resale; ask the Tax Division or a tax professional if you aren't registered yet.
- Keep personal yard sales within four a year and 48 hours each.
